1) The owner agrees to indemnify and hold harmless the City from and against all claims, suits, damages, other liabilities, including attorney’s fees from any loss, injury, or damage sustained or claimed by anyone arising from or alleged to have arisen from the owner’s use, position, maintenance, or repair of the sign which encroaches into the City’s right-of-way. The City does not waive or intend to waive limitations of liability under the CGIA, Sections 24-10-101, et. seq., as amended.
2) The owner shall remove the sign at the owner’s expense if the city determines, in its sole discretion, that the sign interferes with the use of the public right-of-way.
3) The owner shall perform all appropriate and necessary maintenance and repair work on the sign so as to maintain it in a good and safe condition.
The provisions relating to the encroachment of the owner’s sign into the public right-of-way shall survive the termination, revocation, or closure of the permit.
